Democrats and Republicans are in for a fight over President Donald Trump's veto on his emergency declaration.

Arizona Reps. Greg Stanton, a Democrat, and Paul Gosar, a Republican, fall along party lines.

Stanton confirmed that Democrats are preparing for heavy litigation in an effort to convince the Supreme Court to overturn Trump's veto.

Gosar and other Republicans are confident the court will see it their way and have invited the challenge.

"This has better validation than most previous other declarations," Gosar said.

He warned that a challenge could also backfire.

"The court may say, 'Listen there's justification for an emergency declaration on the fence. There is none for DACA, one goes away, and one gets built," he imagined.

He suggested the court could go even further and force a compromise by enjoining the DACA dilemma under Trump's emergency declaration.

Stanton doubted Gosar knows what the court will do, and said he expects justice will prevail over Trump.

"Our entire system of government is based on checks and balances. And, so there should not be an unchecked power of anyone in government including the President of the United States."
