Some abortions will resume in Arizona two weeks after a near-total ban on the procedure went back into effect. The Arizona Court of Appeals has issued a stay on a lower court judge’s ruling, temporarily blocking enforcement of the ban.

A Pima County Superior Court judge on Sept. 23 had ruled Arizona could once again enforce its Civil War-ear ban on abortions that makes exceptions only to save the life of the mother. The ruling meant Arizona providers had to halt abortion services. Some abortion clinics had begun referring patients to clinics in other states.

Planned Parenthood Arizona is in the process of appealing the Superior Court judge’s ruling. The organization had asked the appeals court to issue the stay.

“While today’s ruling brings temporary respite to Arizonans, the ongoing threat of this extreme, near-total abortion ban that has no regard for the health care of those across the state, including survivors of rape or incest remains very real,” Brittany Fonteno, president and CEO of Planned Parenthood Arizona, said in a press release.

Fonteno said Planned Parenthood Arizona would resume abortion services now that the stay has been granted.

A hearing is scheduled for Oct. 11 to determine if the case should be accelerated.
