Department of Justice Lawsuit Against MCSO Headed For Trial

Another lawsuit alleging discriminatory policing by the Maricopa County Sheriff’s Office could soon go to trial.

The U.S. Department of Justice sued the Sheriff’s Office in 2012. On Wednesday, U.S. District Court Judge Roslyn Silver scheduled a 15-day bench trial to begin on Aug. 10.

The DOJ suit is separate from an earlier racial profiling suit the Sheriff’s Office lost two years ago after a 2012 trial.

That case, known as Melendres v. Maricopa County, is a class-action lawsuit filed by Latino motorists in 2008. The judge in that case ruled the Sheriff’s Office had systematically discriminated against Latinos during traffic stops. He ordered the Sheriff's Office make a series of changes to prevent profiling and appointed an independent monitor to ensure the sheriff's compliance.

Maricopa County Sheriff Joe Arpaio is now facing contempt of court for violating the judge’s orders in that case.

The DOJ’s suit includes similar claims made in the Melendres suit, and also accuses the Sheriff’s Office of discriminating against non-English speaking jail inmates and retaliating against critics.

The date of the trial could be subject to change if attorneys have conflicts.
