An aid worker arrested ten months ago for allegedly helping two men illegally enter the U.S. was in court Tuesday afternoon asking the judge to dismiss his case.

Shortly after Scott Warren was arrested in January, defense attorneys took on his case for free.

At the time, he was the first known aid worker along the southern Arizona border arrested on human smuggling charges. A month later, a federal grand jury indicted the 35-year old on two felony counts.

Warren said he was bringing food, water and clothing to two immigrants who sought shelter managed by the “No More Deaths” humanitarian organization.

His attorneys have asked the court to dismiss the felony charges because texts between officers on the scene show the officers did not follow proper search warrant codes under international law.
